Purpose

This PICS sets out the policies of Gammon Construction Limited ("Gammon") and your rights as data subject in relation to the personal data collected, used and stored by Gammon.

Compliance with Personal Data (Privacy) Ordinance (Cap 486) ("PDPO")

Gammon will comply with the requirements of the PDPO.

Purposes for Collection of Personal Data

Gammon collects your personal data for the following purposes:

• for responding to your enquiry and communication;
• for consideration of your work experience and suitability for the job vacancies within the Gammon Group as advertised on its website: www.gammonconstruction.com;
• for forming part of job candidates data base necessary for the operation carried on by the Human Resources Department of Gammon;
• for observing any legal, governmental or regulatory requirements of the Hong Kong Special Administrative Region or other relevant jurisdiction including any disclosure or notification requirements to which Gammon is subject; and/or
• for any other purposes related to and/or in connection with and/or for the furtherance of any of the above purposes.

With your consent, Gammon may also use your personal data in direct marketing. You may contact us at any time to opt out from direct marketing.

Collection and Scope of Personal Data

The personal data collected by Gammon includes:

• Name;
• Identity Card No/Passport No and copy;
• Occupation/Profession;
• Address;
• Telephone and fax numbers;
• E-mail address;
• Work experience;
• Education background; and/or
• Professional qualification.

All personal data will be collected on a voluntary, open and fair basis. Whilst you are entitled to refuse to provide or withhold the disclosure or provision of any of the aforesaid personal data, incomplete disclosure may prevent Gammon from conducting a complete assessment of your suitability for a particular position or shortlisting you for an interview or from assisting you in your enquiry or communication.

Accuracy of Personal Data

Gammon will take all practicable steps to ensure that the personal data so collected are accurate, having regard to the purposes set out above. However, your efforts to provide accurate personal data in your resume or enquiry or communication (if applicable) and thereafter to update Gammon of any change in your personal data will be required to assist us in maintaining accurate personal data.

Right of Access and Correction

You as a data subject have the right to know (i) the PICS of Gammon, (ii) whether Gammon holds any of your personal data; and (iii) the extent of the personal data being held by Gammon. You also have the right to request access to and correction of your personal data held by Gammon at any time. Personal data of unsuccessful applicants for any positions within the Gammon Group will be destroyed by Gammon after 1 Year from the respective dates of rejection of their applications. The unsuccessful applicants may request the destruction of their personal data if they do not wish them to be used for future recruitment purposes.

In accordance with the PDPO, Gammon has the right to charge you a reasonable fee for processing and complying with your data access request.

Security and Storage of Personal Data

All personal data are stored in a secure place and/or system to the extent that any unauthorized access is strictly prohibited.

Transfer and Disclosure

Unless you shall have notified us to the contrary, your personal data may be transferred and/or disclosed to:

• Employees and officers of Gammon; and/or
• partners or affiliated, associated or subsidiary companies of Gammon in the event of a job vacancy which is commensurate with your work experience and qualification.

We, Gammon Pte. Limited and Gammon Construction and Engineering Pte. Ltd., recognize our responsibilities in relation to the collection, holding, processing and use of Personal Data of our employees under the Personal Data Protection Act 2012 (“PDPA”). We set out below our policy for handling personal data collected about our job applicants.

1. Type of personal data we collect

We collect data that can be used to identify a natural person (“Personal Data”). Examples of Personal Data include your name, nationality, date of birth, gender, contact details (address, email address, telephone numbers etc.), your NRIC, FIN or passport numbers, photographs, marital status, current occupation, health or medical records, character references and testimonials, your CCTV images.

We may also collect Personal Data of your family members or other persons you know. If you have provided those to us, it means that you have obtained their respective consent to our collection, use and disclosure of their personal data for the purpose set out in this Statement.

2. Purpose of Collection, use and disclosure

The Personal Data provided by or otherwise collected from you is or may be used for the following purposes:

1. assessing, processing and contacting you in relation to your job application;
2. validating all references provided and conduct screening and background checks;
3. assessing you for other job opportunities with us or our parents, subsidiaries and affiliated companies, both locally and overseas;
4. complying with our internal policies, procedures and directives;
5. reviewing and improving our recruitment policies and processes;
6. research, planning, statistical analysis and policy development relating to human resource management; and
7. any other purposes relating to or arising out of the above.

We may disclose the Personal Data collected from you to third parties to achieve the purposes set out in this Statement. Such third parties may include our holding companies, subsidiaries and affiliates, our service providers, suppliers and agents, regulatory authorities, statutory bodies and public agencies for the purpose of complying with their respective requirements, policies, guidelines and directives.

In addition to the data you provide, we may obtain from third parties (including referees) further data about you which is relevant for the purposes set out in this Statement. In doing so, we may disclose your Personal Data to such third parties.

We may further collect, use and disclose Personal Data where required or permitted by law for any purpose.

3. Storage and retention

All Personal Data shall be stored in a secure place and/or system to the extent that any unauthorized access is strictly prohibited. We will retain your Personal Data for a reasonable period in accordance with our legal and business purposes.
